What is Arbitration?
Arbitration is a traditional form of alternative dispute resolution that provides parties a streamlined private process to resolve disputes. Arbitration is a binding procedure because the arbitrator renders a decision that is final and binding, subject only to limited court review.
Arbitration is often "administered" by a private organization, like Cobb Mediation, LLC, that maintains lists of available arbitrators and provides rules under which the arbitration will be conducted. The parties to a dispute present their arguments and evidence to an arbitrator at an arbitration hearing who decides the case and resolves the dispute.
At Cobb Mediation, arbitrators base their decisions on published rule sets and substantive law.
Parties often select arbitrators on the basis of their substantive expertise in the subject area of dispute.
