Does The Center for Legal Solutions Offer a Non-Binding Arbitration Service?
Non-Binding Arbitration is conducted much like a binding arbitration, except that when the arbitrator issues the award after the hearing, it is not binding on the parties and they do not give up their right to a jury trial. In these cases, the arbitrator's award is merely an advisory opinion.
Arbitration proceedings conducted under The Center for Legal Solutions’ Rules for Arbitration typically result in awards that are binding on the parties. The parties, however, may agree in writing that the arbitration shall be non-binding.
If parties are interested in non-binding arbitration, The Center for Legal Solutions suggests that they consider case evaluation. Case evaluation, or early neutral evaluation, is an alternative dispute resolution process in which parties present summaries of their respective cases to a neutral case evaluator who renders a non-binding evaluation of the case to the parties. This process provides the parties a non-binding “decision” from an experienced neutral without the time and expense called for in binding arbitrations.
