What if My Pre-Dispute Arbitration Clause Calls for Arbitration Under Another Set of Rules or with Another Organization?
The Center for Legal Solutions’ Rules for Arbitration includes a “Choice of Rules” Rule:
If the Parties agree to follow other published rules for arbitration, such as American Arbitration Association (AAA) rules, those rules, which are not inconsistent with applicable law shall apply. The parties shall promptly notify The Center for Legal Solutions of any such agreement and confirm such rules in writing.
Therefore, arbitrations can be conducted under the auspices of The Center for Legal Solutions according to a specific set of rules identified in a pre-dispute arbitration agreement.
If the parties have agreed to arbitrate under the auspices of another organization, that agreement is controlling unless the arbitration participants mutually agree to arbitrate with The Center for Legal Solutions.
