Mediation Saves Time, Money and Reduces Risk.

Mediation saves time and money in comparison to courtroom litigation. Mediation also provides the parties an opportunity to control the outcome of their case and avoid the uncertainty and risk of a trial.

The high cost and long delays associated with trials often makes litigation an impractical method of resolving disputes. It is not uncommon for the attorney's fees, expert witness fees, jury fees, court reporter fees and other related costs to exceed the amount in dispute. Increasingly, both plaintiffs and defendants find that courtroom litigation is a cost inefficient means to pursue their legal interests.

Can't the Parties Negotiate on their Own?

Some may wonder why the parties, own their attorneys, can't simply pick up the phone to reach a settlement without the time and expense of mediation. Attorneys often fear that the making of any "reasonable" settlement offer will be taken as a sign of weakness. Quite often, their role of adversary professional causes many lawyers to respond aggressively or initiate preemptive strikes that the other party finds threatening. It is difficult for a lawyer to take care of a client and to play a mediative role at the same time.

Mediation has proven to be a more condusive enviroment for settlement negotiations. Unproductive discussions can be avoided and concessions or proposals will be communicated only if they are likely to lead to a settlement. The American Arbitration Association reports that over 85% of all mediations result in a settlement.

Even if mediation only succeeds in improving the parties’ communication, in identifying their underlying interests, in narrowing the issues in conflict, or in helping them evaluate their interests, it can move the dispute towards a quicker, more cost effective resolution.
