How to Prepare for Mediation

Before their scheduled mediation session, parties may submit a brief Mediation Statement to their mediator to provide a summery of the basic facts and issues in their dispute.

The Mediation Statement may summarize any efforts that have been undertaken by counsel to settle the case and any specific problems that have hindered resolution of the case. This Statement is strictly confidential. It will not become part of the court record or shared with other parties.

At the outset of a mediation session, all parties are typically given an opportunity to make brief statements about the case. Often, the parties, or their representatives, will prepare a statement ahead of time. In some cases, an statement can help convey information about the case in a compelling and time efficient manner. Parties are not required to make elaborate presentations, but may choose to do so.

It is important to come to mediation with a good attitude. Often, mentally preparing to consider possible solutions, rather litigation strategy is the best way to prepare for mediation.

In domestic relations cases, mediation sessions may be more productive if participants have completed court-required forms, including the domestic relations financial affidavit, child support worksheets and the parenting plan. You may download copies of these forms from the Cobb County Law Library Self-Help Center and the Georgia Child Support Commission.

In preparation for mediation, parties may wish to review the FAQ: What to Expect in Mediation.
