Christmas Tour The Historic Anderson Mansion was a featured destination on this year's Marietta Pilgrimmage Christmas Home Tour and was the site of the Olde Marietta Tearoom.

    Mediation is an effective method of resolving disputes in the business community for several reasons. First, the parties typically already know one another and know most or all of the facts which are relevant to their dispute. Second, litigation imposes a tremendous burden on the parties. Simply organizing, copying and reviewing documents can cost companies thousands to hundreds of thousands of dollars. Another reason that mediation works in commercial cases is that the mediator can help parties find solutions that minimize risks and repair damaged relationships.

    Creative Solutions

    The options available to a judge or jury in commercial litigation are extremely limited. Typically, one party will prevail and may be entitled to a sum of money. While favorable judgments may produce a windfall in some cases, they rarely produce creative solutions to business problems.

    Mediated settlements of commercial disputes can provide parties an opportunity to restructure contracts, negotiate payment plans, repair or help mitigate damages, create options and win-win solutions.

    Mediation is a flexible process. Parties may mediate with or without attorney representation. Parties may mediate while litigation is pending or before engaging the legal process.

    How Much It Costs, How Long It Takes

    The time required to mediate a commercial dispute depends upon the complexity of the issues involved, how willing to parties are to engage the process and the number of parties involved. According to our research, the average length of mediation is about three hours and the parties should expect to commit at least three hours to the mediation process. Mediation sessions can be scheduled at times that are convenient to all parties.

    Our mediators charge varying rates for their time and you are encouraged to browse individual mediator profiles for rate information. The cost is typically shared equally by the parties.
